Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all Services provided by Rochen, supplements Rochen's Terms of Service ("TOS"), and forms part of the Agreement. By using the Services, you agree to comply with this AUP.

This AUP is intended to help protect the Services, Rochen, our customers, and third parties from unlawful, harmful, abusive, excessive, or disruptive activity. It also explains how we may manage fair use, shared platform resources, and usage that may result in additional or usage-based charges under the Agreement.

Capitalized terms used but not defined in this AUP have the meanings given in the TOS.

Nothing in this AUP excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable law.


1. Prohibited use

You may not use the Services in any way that:

  1. violates any applicable law or regulation;
  2. infringes or misappropriates any intellectual property, privacy, publicity or other rights of any person or organization;
  3. stores, publishes, transmits, distributes, executes or makes available malware, ransomware, spyware, viruses, Trojans or other malicious code;
  4. facilitates phishing, fraud, deceptive practices, spoofing or impersonation;
  5. sends spam, unsolicited bulk communications or other unlawful or abusive messages;
  6. attempts to gain unauthorized access to any account, system, network, device or data;
  7. interferes with, disrupts or degrades any Rochen system or Service, or any third-party system or service, including through denial-of-service or similar activity;
  8. performs or attempts to perform security scanning, vulnerability testing, penetration testing or benchmarking against any Rochen system or other third-party system without prior written approval;
  9. operates an open relay, anonymous proxy, VPN, IRC service, torrent service or other service commonly associated with abuse unless we have expressly approved it in writing;
  10. involves cryptocurrency mining or related activities;
  11. hosts, distributes or links to content that is unlawful, fraudulent, malicious or abusive; or
  12. relates to activities where service interruption or failure could lead to serious consequences, including personal injury, environmental damage or significant financial or operational loss.

You are responsible for all content, applications, scripts, code, credentials and activity under your Account, including activity carried out by your users, clients, employees, contractors or anyone else using the Services directly or indirectly through your Account.


2. Security and platform protection

You must use the Services in a way that helps maintain the security and integrity of the platform.

You must not:

  1. fail to take reasonable steps to update, patch or remove software with known security vulnerabilities, including core applications, plugins, themes, extensions, libraries or dependencies;
  2. run software that has reached end-of-life status or is no longer receiving security updates from its developer, unless appropriate mitigations are in place or Rochen has approved it;
  3. fail to take reasonable steps to secure all access credentials, including using strong passwords, storing credentials safely, limiting access to authorized users and enabling multi-factor authentication where available;
  4. ignore or fail to act on a security issue that we have notified you about; or
  5. use the Services in a way that creates a material and avoidable security risk to the platform, other customers or third parties.

We may take immediate protective action, including suspending the affected Service, as we reasonably consider necessary, to address a security incident, abuse event or other material threat.


3. Shared services and fair use

Shared Compute Tier Services and any other shared hosting or multi-tenant Services are intended for normal website, application, database and related hosting use.

Although Shared Compute Tiers include defined resource limits, these represent the maximum shared resources available to a site. Shared services are not intended for continuous or sustained utilization at that level, and availability of those resources is not guaranteed at all times. Workloads requiring sustained high resource usage or consistent resource availability may be better suited to a Dedicated Compute Pool, Managed Cloud Server or another suitable Service.

Shared services are designed for typical website and application workloads. We do not apply fixed legacy-style CPU or RAM limits through this AUP. Instead, we apply a fair use approach to keep the overall platform stable and responsive.

You may not use shared services in a way that, in our reasonable judgment:

  1. consumes excessive or disproportionate shared resources over a sustained period;
  2. materially degrades the performance, stability, security or availability of the platform or other customers' services;
  3. goes beyond the normal intended use of shared hosting services;
  4. uses shared services primarily for bulk storage, archival storage, offsite backups, file dumping, public download distribution or similar purposes outside the scope of normal website or application hosting; or
  5. uses shared services primarily for batch processing, resource-intensive automation or frequent scheduled tasks that place sustained load on the platform.

If your usage exceeds fair use for a shared Service, we may take proportionate action reasonably necessary to protect the platform and other customers. This may include rate limiting, temporary technical controls, process restrictions, requiring optimization of your website or application, assigning a higher Shared Compute Tier, migrating the affected Service to a Dedicated Compute Pool, Managed Cloud Server or another suitable Service, or suspending the affected Service.


4. Email use and anti-spam

Rochen has a zero-tolerance policy for spam, phishing and abusive email activity.

You may use Rochen email Services, including campaign or bulk email functionality where available, only if you comply with UK GDPR, PECR, EU GDPR, Canadian PIPEDA and any other applicable privacy, marketing and electronic communications laws and regulations in the jurisdictions relevant to your use of the Services.

In particular, you must:

  1. obtain consent where consent is required by law;
  2. rely on the soft opt-in only where it is legally available;
  3. maintain accurate records of consent or other lawful marketing basis where relevant;
  4. include a clear and effective unsubscribe or opt-out mechanism in each applicable message;
  5. avoid using purchased, rented, scraped or harvested mailing lists;
  6. avoid altering or misrepresenting headers, sender identity or routing information; and
  7. avoid sending deceptive, unlawful, malicious or reputation-damaging email.

To protect platform stability, email deliverability, sender reputation, security and compliance, we may queue, rate-limit, reject, filter or block email as we reasonably consider necessary.


5. Usage-based billing

Some Rochen Services are usage-based or include usage allowances with additional usage billed separately. Depending on the Service, this may include sites, storage, compute, outbound data transfer, outbound email and other metered Services.

You are responsible for all usage incurred through your Account, websites, applications, scripts, credentials and end users, except to the extent the usage results solely from our own error.

Usage above any included amounts will be billed at the rates set out on our pricing page, or in any applicable Service-Specific Terms agreed when the Service is ordered, unless those rates are later changed in accordance with the Terms of Service or other applicable terms.

If usage charges become overdue, if payment collection fails, or if your usage creates a material financial, platform stability or security risk, we may require immediate payment, advance payment or a deposit, or suspend or restrict the affected Services as we reasonably consider necessary.


6. Suspension and enforcement

If we reasonably believe that you have materially breached this AUP, we may take proportionate action that we reasonably consider necessary to protect the platform, other customers or third parties.

This may include:

  1. issuing a warning;
  2. removing, disabling or restricting access to content, scripts, processes or email;
  3. applying temporary or permanent technical restrictions;
  4. suspending affected Services;
  5. requiring remediation, optimization or a migration to a more suitable Service; or
  6. terminating Services for serious or repeated breaches.

Where reasonably practicable, we will give notice before suspension or termination.

We may act without prior notice where immediate action is reasonably necessary to address unlawful activity, abuse, security threats, material risk to the platform, risk of harm to third parties or urgent operational issues.

We may also report unlawful activity to law enforcement, regulators, network operators or other relevant third parties where appropriate.


7. Customers providing services to others

If you provide services to third parties, including clients or anyone you allow to access or use the Services, you are responsible for their compliance with this AUP.

Any act or omission by those clients or users that would breach this AUP will be deemed to have been carried out by you and will be treated as a breach of this AUP by you.


8. Changes to this AUP

We may update this AUP from time to time by posting a revised version on our website.

Any changes will take effect from the date stated in the updated version, unless a later date is stated.

Your continued use of the Services after the updated AUP takes effect constitutes acceptance of the revised AUP, subject to any rights you may have under applicable law or under the Terms of Service.

To report abuse or a suspected violation of this AUP, please contact us at abuse@rochen.com. Depending on the nature of the report, we may not be able to provide a response.
